Website owner, the offering, and binding of Terms

This website is owned and operated by Wix. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors the ability to schedule and book wheelchair transport services. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.
By requesting services through the website, phone, email, text message, or any other communication method, you agree to be bound by these Terms.
Key Commercial Terms Offered to Customers

When purchasing or booking a service, you acknowledge and agree that:
(i) you are responsible for reviewing all service details, pricing information, and applicable terms prior to confirming a booking; and
(ii) you enter into a legally binding agreement to purchase services from Handy Transit LLC when you confirm a booking and complete the applicable payment or authorization process.
Prices for services may be listed on the website, provided in writing, or communicated verbally, and may include estimates based on anticipated service details. Actual pricing may vary based on service duration, distance, wait time, assistance requirements, route changes, or other operational factors. Handy Transit LLC reserves the right to update pricing at any time and to correct errors.

A deposit or reservation fee may be required to secure a booking. This deposit reserves availability and is applied toward the total transport fee unless otherwise stated.
​
Final charges may be adjusted following service completion to reflect actual services rendered. An updated invoice reflecting any such adjustments will be issued following service completion, and any remaining balance is due in accordance with the Payment, Reschedule & Refund Policy.
Acceptance of service constitutes acceptance of final charges.

Payment, Reschedule & Refund Policy

Deposits & Reservations
​
At the time of booking, you may be required to pay a reservation fee or deposit to secure your transport. This fee reserves your scheduled service and constitutes a portion of the total transport cost.
Final Charges & Invoice Adjustments
​
The total transport fee is based on actual service time, including but not limited to:

Travel time
-
Wait time at pickup or drop-off

Additional assistance provided beyond initial estimates

Following completion of service, you will receive a final invoice reflecting any adjustments. If the final amount differs from the deposit paid, the remaining balance is due upon receipt of the invoice.
Card Authorization & Auto-Charging
​
Customers may choose to securely store a payment method at checkout for convenience. By selecting this option, you authorize Handy Transit LLC to charge the stored payment method for any remaining balance due following service completion or if payment is not received within two (2) calendar days of invoice delivery.
Saving a payment method is optional; however, failure to save a payment method may require manual payment arrangements and may delay completion of billing.
This authorization applies whether payment is processed through Wix Payments, Stripe, QuickBooks Payments, or any other designated Payment Processor.

Failed Payments
​
If a payment attempt fails, Handy Transit LLC may reattempt the charge, issue a revised invoice, suspend future bookings, or require alternative payment arrangements prior to providing additional services.

Cancellations & No-Shows
​
Cancellations require at least 24 hours’ notice to qualify for a refund of the reservation fee. Cancellations with less than 24 hours’ notice or failure to appear for scheduled transport may result in forfeiture of the reservation fee. Handy Transit LLC retains sole discretion in determining no-show status.
Retention of right to change offering
We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.
Changes to payment methods, invoicing systems, or billing practices do not affect the enforceability of previously granted payment authorizations or outstanding balances owed.

Chargebacks & Disputes
​
In the event of a payment dispute or chargeback, you agree to cooperate with Handy Transit LLC and its Payment Processors by providing accurate information regarding services rendered. You acknowledge that service completion records, invoices, GPS data, and communication logs may be submitted as evidence in dispute resolution.
Warranties & responsibility for services
​
When we receive a valid claim for a service purchased from us, we will do our best to remedy the situation in a timely manner. Should we not be able to fulfill our obligation, the customer will be entitled to a full refund or an equal exchange toward the next service.

Non-Emergency Transportation Disclaimer
​
Handy Transit LLC provides non-emergency transportation services only. We do not provide medical care, diagnosis, treatment, or medical monitoring. Our drivers and staff are not medical professionals.
In the event of a medical emergency during transport, Handy Transit LLC personnel will make reasonable efforts to seek assistance, including contacting emergency services when appropriate.
However, Handy Transit LLC is not responsible for medical outcomes, delays caused by emergency response, or conditions arising from a passenger’s underlying health status.

Passenger Capability & Assistance Limitations
​
Handy Transit LLC provides non-emergency transportation services to passengers of varying mobility levels, including ambulatory passengers and those who use wheelchairs, scooters, or other mobility devices.
​
While drivers may provide reasonable assistance related to the transportation service itself, Handy Transit LLC does not provide personal caregiving, medical supervision, clinical assistance, or services beyond those reasonably associated with non-medical transport.
​
Passengers and their representatives are responsible for ensuring that the passenger’s physical, cognitive, and medical condition is appropriate for non-emergency transportation without ongoing personal or medical care. If a passenger requires assistance beyond transport-related support, such care must be provided by the passenger or a third party.

Passenger Readiness & Wait Time
​
Passengers must be ready for transport at the scheduled pickup time. Delays caused by passenger unavailability, readiness issues, facility delays, or other factors beyond Handy Transit LLC’s control may result in billable wait time at the applicable rate.

Force Majeure & Service Delays
​
Handy Transit LLC shall not be liable for delays, service interruptions, or inability to perform services due to events beyond our reasonable control, including but not limited to severe weather, road closures, traffic conditions, accidents, government actions, natural disasters, or mechanical failures.

Ownership of intellectual property, copyrights and logos
The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Handy Transit LLC. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.
Right to suspend or cancel user account
We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. The Payment, Reschedule & Refund Policy still stands.
Indemnification
You agree to indemnify and hold Handy Transit LLC harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.
Limitation of liability
To the maximum extent permitted by applicable law, in no event shall Handy Transit LLC, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.
To the maximum extent permitted by applicable law, Handy Transit LLC assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
Right to Change and Modify Terms
We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.
Promotional Emails & Content
You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time.
Preference of Law & Dispute Method
These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of The United States / Texas, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Georgetown, TX.
